The cost equation for fashion just changed. For most of the industry’s history, your financial responsibility ended at the sale. Design it. Manufacture it. Sell it. What happened after that was someone else’s problem.
That model is now law in five countries, accelerating across the EU, and live in California as of 2024.
Here is what every brand leader needs to understand:
It Started In France In 2007: Refashion, France’s producer responsibility organization, has over 14,000 registered brands today. Brands selling into France without a Unique Identification Number face fines of up to €7,500 per unit. If you sell into France and are not registered, you are out of compliance right now.
The EU Is Making It Universal: The Netherlands, Sweden, Hungary, Latvia, Spain, and Italy all have active or imminent EPR systems. Once the EU harmonized directive is adopted, member states have 18 months to transpose it into law. Every brand with meaningful EU exposure has obligations today or will shortly.
California Went First In The US: SB 707 was signed in September 2024. CalRecycle approved Landbell USA as the sole PRO on February 27, 2026. All covered producers must join by July 1, 2026. Full enforcement with daily fines up to $50,000 begins July 1, 2030. A public non-compliance list will be published. Your retail partners and investors will see it.
Other States Are Watching: New York, Colorado, Washington, and Massachusetts all have related frameworks in motion. This is not a California-only problem.
The Brands That Move First Win: Compliance is the floor. The brands that register early, audit their product for eco-modulation impact, and build EPR costs into their financial model will turn a regulatory burden into a brand differentiator with consumers, wholesale partners, and PE investors.
